Why is downloading alias episodes 'illegal' and not to be discussed, when taping, tape trading and all that OK and totally cool?

Tivo and DVD recorder/players record in mpeg2, which is often the same video format as your downloaded episodes. So then its a question of media? It seems like a pretty blurry line. Its as if, when it passes through the hands of your postal carrier it gets the federal blessing of legality.

If someone recorded a dvd-r from their dvd recording unit on their television, then burned it to a CD for me, how is that different than a duplicate vhs tape made?

Is it just that priacy of software and movies is such a hot button issue right now? I'd like to state something i learned a long time ago about the internet. If enough people can figure out how to do it, its no longer illegal. Unless i'm wrong and one day the feds bust 47 million people for kazaa use.
